Cremation is on the rise (approaching 40% in Metro Manila) requiring a different kind of interment - inurment at ash crypts. There is no other recourse except to buy ash crypts because memorial park plots are scarce and sky high in prices. Ash crypts are cheap and can accommodate up to 4 urns Available at La Union, Pangasinan, Calamba and Morong. Inquire now

Usufruct is not subject to CGT https://carpolaw.com/wp-content/uploads/2018/07/Monthly-Tax-Update-Philippines-May-2018.pdfA CONTRACT OF USUFRUCT IS NOT SUBJECT TO CAPITAL GAINS TAX; HENCE, A CERTIFICATE AUTHORIZING REGISTRATION IS NOT REQUIRED IN ORDER FOR THE SAME TO BE ANNOTATED ON THE TITLE OF THE PROPERTY. A Contract of Usufruct does not involve transfer, conveyance or disposition of any portion of the real property or its ownership. A Contract of Usufruct is not a sale of transfer of real property because the owner of the property retains ownership thereof as it is expressly stated in the Contract that landowner reserves the right to sell, transfer, dispose of, mortgage, charge, hypothecate, create liens over or encumber the property to, or in favor of, a third party. Such being the case, the landowner is not subject to the payment of capital gains tax (CGT) imposed under Section 27 (D) (5) of the NIRC of 1997, as amended. It is however understood that the income, if any, derived by the Usufructuaries from and as a consequence of the grant of the right to use the said property is subject to income tax.It should be noted that CGT is a tax imposed on the gains presumed to have been realized by the seller from the sale, exchange, or other disposition of capital assets located in the Philippines, including pacto de retro sales and other forms of conditional sale. Reflection on the JV:1. Let us format this initial discussion as Lease (rent lease) lease plus % of sales so that she will not be part of the operations.2. Then for columbarium either we do a usufruct,, which gives us full right to use and dispose off the ash crypts, and lessens chances of her interferenceand frequent visits to the courts. Its either that or nothing. She might give me head ache. Why Usufruct - no more extradjudicial settlement in case of death of LJ or due to changes in the ownership due to death. No estate taxes to be paidWe do this for both LJ and La Union.3. Format of the USUFRUCT between LJ and us.Parties: Land owner and the USUFRUCTUARY (BENEIFICIARY)Purposes: ObjectivesFor LJ: 1.
